The ACLU is suing to stop the patenting of human genes on the grounds that human genes are natural phenomena, which cannot be patented. From a legal point of view the case seems like a slam-dunk to me, and I predict that the district court will rule that way. I then predict that the Supreme Court will overturn that ruling on a 5-4 vote (possibly 6-3 if Justice Bryer retires before then and Obama is snookered into replacing him with a neocon sleeper).
